You are recognized as a Convention refugee by another country that you can return to
If your claim is referred to the IRB, they will determine whether you are a Convention refugee or a person in need of protection. Convention refugees are individuals who are outside of their home country or the country they normally reside in, and are unable to return due to a
well-founded fear of persecution based on race, religion, political opinion, nationality, or being part of a social group (such as women or people of a particular sexual orientation). A person in need of protection is someone in Canada who cannot safely return to their home country due to the risk of torture, danger to their life, or risk of cruel and unusual treatment or punishment.
Under the Safe Third Country Agreement, people seeking to make a refugee claim must do so in the first safe country they arrive in. This means that if you enter Canada from the United States at a land part of entry, you are not eligible to make a refugee claim in Canada. There are certain exceptions to this rule, such as if you have family in Canada.
You’ve graduated but now want to work, live, and play in Australia.
The Temporary Graduate Visa (subclass 485) is a temporary visa that allows international graduates in Australia to live, work or continue studies after they have finished their course.
Applicants for the new SC 485 Replacement stream can apply from inside or outside Australia starting 1 July 2022.
Current and former Temporary Graduate visa holders who lost time in Australia due to COVID-19 travel restrictions can get another SC 485 visa of the same duration as their original visa if they:
• were outside Australia when the original SC 485 visa was granted and entered Australia on the original visa before 15 December 2021, departed Australia after this entry but before 15 December 2021 while holding the original visa,
or
• were in Australia when the original SC 485 visa was granted and were outside Australia at any time between 1 February 2020 and 14 December 2021 while holding the original visa.
If the primary visa holder is eligible, secondary visa holders who were granted visas on the basis of being the member of the family unit of the primary visa holder will also be eligible for the Replacement stream.
Holders of SC 485 Post Study stream visas who were required to live in regional areas for the grant of a second SC 485 and were disrupted by the COVID arrangements, may now meet this requirement if they have studied on a student visa and lived on their Replacement stream SC 485 visa in a regional area.
This Instrument applies to applications for SC 485 visas made on or after 1 July 2022.
Received Confirmation of Enrolment (CoE) from the Education Provider.
The education provider will do its own GTE assessment. If the student passes the assessment, they will receive a letter of offer. Pay the Tuition fee to the Institute to receive the CoE.
Approval of the individual to enter and remain in Australia for purpose of full-time study.
Once the applicant has the CoE and Insurance OSHC covering the period of study, confirm that applicant meets the English Financial and GTE criteria to be granted a student visa.
